Peru is seeking to test new business models and facilitate innovation in the telecommunications sector.
The country’s telecom regulator, Osiptel, launched a public consultation to define the regulatory framework for a sandbox, with a deadline for submitting contributions of Mar 16, 2026.
The objective is to balance technological innovation with the protection of users' rights and to facilitate the launch of new services or business models that would be unfeasible under current regulations.
A sandbox is a controlled experimental environment created by regulatory bodies that allows companies to test innovative products, services and business models under rules that are relaxed or suspended for a limited period.
Such a testbed seeks to foster innovation without compromising security, while monitoring risks before formal regulations are adopted.
In the public consultation document, Osiptel cites international experiences and lists countries in the region such as Brazil, Chile, Mexico, Colombia and the Dominican Republic as having defined frameworks for regulatory sandboxes.
Consultation
In the consultation, Osiptel poses six questions regarding the aspects that should be considered to define the framework required to establish a telecommunications regulatory sandbox in Peru.
Do you consider it necessary for Osiptel to have a regulatory sandbox mechanism? Justify your answer and, if relevant, indicate what other regulatory flexibility mechanisms could constitute alternatives to the regulatory sandbox.
What type(s) of project(s) would you propose to improve the provision of telecommunications services that could be evaluated by Osiptel for inclusion in regulatory sandboxes?
Considering the proposed project(s), which regulations issued by Osiptel might require regulatory flexibility to facilitate their implementation?
What risks for users or companies could arise from the proposed regulatory flexibility? What risk mitigation measures should be implemented?
What eligibility criteria do you think Osiptel should consider when selecting those who will enter the regulatory sandbox?
What type of performance indicators should be used to evaluate the success or failure of the proposed project(s)?
